By continuing to access our website you are agreeing to comply with and be bound by the following terms and conditions of use, which govern Your Balance Project's relationship with you in relation to the website and studio. The term ‘you’ refers to the user or viewer of our website. We reserve the right to update, change or replace any part of these terms and conditions at any time. It is your responsibility to periodically check our website for changes. By using this website you agree to be bound by the terms below.

General terms

The following legal agreement applies when registering online for any and all classes. Your Balance Project is not liable to refund, transfer or offer compensation of any kind for classes that are late, changed or cancelled for any reason. Classes are subject to change or cancellation without notice. Teachers are subject to change without notice. Classes at Your Balance Project may be physically strenuous and you voluntarily participate in them with full knowledge that there is risk of personal injury, property loss or death. Your Balance Project is in no way liable for any injury, loss of property or death resulting from attending our studio. Class payment must be made upon booking. Your Balance Project does not offer refunds on services or products for change of mind, injury, illness, change of address or any other reason. All purchases are final. All passes and memberships are non-transferable.

To the full extent permitted by law, our liability for breach of an implied warranty or condition is limited to the supply of the goods and/or services again or payment of the costs of having those goods and/or services supplied again. We accept no liability for any loss whatsoever including consequential loss suffered by you arising from products and/or services we have supplied.

COVID-19 Restrictions

By purchasing any of the services offered by Your Balance Project you agree to observe any COVID-19 restrictions or recommendations imposed by the Victoria Government and/or the Australian Government.

Limit of liability

To the maximum extent permitted by law, Your Balance Project excludes all liability to you or anyone else for any loss or damage of any kind (however caused, including by negligence) arising from or relating in any way to the use of this website or any of the content. This includes, but is not limited to, the transmission of any computer viruses or anything else that may interfere with or damage the operations of your computer systems. Your Balance Project will not be liable to users of this website for any indirect, incidental, special or consequential loss arising from or relating in any way to the use of this website.

Bookings and cancellations policy

We have implemented late cancel and no show fees to ensure everyone has a chance to attend. Please only book for classes you know you can attend as we do not provide refunds if you cannot attend your class of choice. If you book into class and are unable to attend, please early-cancel at least 24 hours before your class (group, semi privates and private classes) is due to start. You can do so via your
online booking system. If you fail to do so you will incur a late cancellation/no show fee, for the total cost of the class.

Intellectual property

Unless otherwise indicated, Your Balance Project owns all copyright of the material on the Website. All registered or unregistered trademarks used on the Website are the property of their respective owners.

All copyright, data, text, software, images, graphics, trademarks, logos, interfaces, photographs, and other intellectual property (Content) on the Website is owned, controlled by, or licensed to Your Balance Project. Except for viewing the content for your own personal non-commercial use. The use of this website is for personal and non-commercial purposes only. If you wish to reprint, publish or distribute any material from this website you must first seek written permission from Your Balance Project.

In order to conduct our business and to provide you with services, we may collect personal information about you from our registration forms, website, telephone conversations, e-mails, social media interactions and other written and verbal communications.

The personal information we collect and hold will depend on the personal information you choose to disclose to us. We may, for example, keep a record of your name, date of birth, medical conditions that you disclose to us, occupation, address, telephone numbers, e-mail address, social media addresses, banking details and interests. We will use the information provided to conduct our business and provide you with services, to communicate with you, for record keeping purposes, to improve the quality of our services, for market research, and to track your preferences and activity in our studio and on our website.

Cookies are small pieces of information that are stored by your browser in your computer’s memory and they are used to record how you navigate our website on each visit. Cookies that are used in any part of our website will not be utilised for collecting personally identifiable information and will only be used for internal management purposes. Most browsers automatically accept cookies, but you can usually change your browser to prevent cookies being stored. Please note, if you do turn cookies off this may limit the service that we are able to provide to you. We do not store any information that identifies you inside cookies.

Security of information

We take the security of your personal information seriously. We take all reasonable steps to ensure that your personal information is treated confidentially, kept secure and protected against unauthorised use and is maintained only for the purpose for which it is intended. Please be advised that the internet is not a secure environment. If you use the internet to send us any information, including your email address, it is sent at your own risk.

Packs terms and conditions

Booking changes and cancellation policy

Our cancellation policy is in place to ensure everyone has a chance to attend. Nobody likes additional charges, but everyday classes get fully booked, and sometimes students miss out.

  • Class cancellations can be made via the Bookings Essential Mobile Website or email.

  • Class cancellations can be made up to 24 hours before the class starts time without incurring a charge.

  • Students using an Intro Offer, 1, 5, and 10 Classes Pack who book into a class but cancel the booking within 24 hours of the class start time, will forfeit their class.

  • Cancellations will not be accepted via social media.

Pricing

  • All prices are quoted in Australian Dollars ($AUD) and all transactions are processed in Australian Dollars ($AUD).

  • Prices, products, and offers include GST.

  • All prices are correct at the time of online publication. Prices are subject to change without notice.

  • We reserve the right to amend prices and printing errors.

  • Prices may increase from time to time to reflect increases in cost and benefits.

  • All purchases are final. Your Balance Project does not offer refunds, transfers, suspensions, or extensions on services, workshops, or products for change of mind, injury, illness, change of address, or any other reason.

  • All passes and memberships are non-transferable.

  • Your Balance Project reserves the right to pass on the cost of any additional bank fees which may incur from disputed or failed transactions regarding a student’s account.

Class Packs

  • A pack of ‘5 Classes’ group sessions is valid for 6 weeks from the date of purchase.

  • A pack of ‘10 Classes’ group sessions is valid for 8 weeks from the date of purchase.

  • A pack of ‘5 Classes’ semi privates and privates are valid for 7 weeks from the date of purchase.

  • A pack of ‘10 Classes’ semi privates and privates is valid for 12 weeks from the date of purchase.

  • Your Balance Project does not offer refunds, transfers, suspensions, or extensions on class packs for change of mind, injury, illness, change of address, or any other reason. All purchases are final.

  • Class Packs can be shared online. Please contact us to arrange this.

  • Any non-cancellations, no-shows, or absences, will result in forfeiting that visit. If you do not attend a booked session or cancel within 24 hours of the class start time, you will be charged for the class.

  • The class packs exclude attendance at workshops or special events.

  • Your Balance Project is not responsible if class pack holders cannot use Your Balance Project’s services or facilities because of an event caused by a natural force such as COVID-19 restrictions, extreme weather, or something similar beyond our reasonable control.

    Intro offer

  • Our Intro Offer is available only to new students.

  • Your pass will be activated from the first class booked.

  • Your Intro Offer is valid for 8 weeks from your first class.

  • Classes included in your Intro Offer are non-transferable and non-suspendable.

  • Students who have practised at Your Balance Project previously are not eligible for this offer.

  • Your Balance Project is not responsible if Intro offer holders cannot use the services or facilities because of an event caused by a natural force such as COVID-19 restrictions, extreme weather, or something similar beyond our reasonable control.

Workshops

  • Your Balance Project does not offer refunds or credits on workshops for change of mind, injury, illness, change of address, or any other reason. All purchases are final.

  • If you cannot attend, you may transfer your workshop ticket to another person’s name by calling or emailing Your Balance Project at least 24 hours before the start of the workshop.

  • Payment needs to be made upon booking.

  • Please arrive at least 15 mins before the scheduled start time of the workshop. Late entry to workshops will not be permitted.

  • Any no-show or absence will result in forfeiting that visit. If you do not attend a booked workshop you will be charged. Latecomers will be considered a no-show and you will be charged.

Gift cards

  • Gift Cards can be used for classes at Your Balance Project.

  • Gift Cards are not redeemable for cash.

  • Valid for 6 months from the date of first use.

  • Gift Cards are not transferable.

  • Your Balance Project does not offer refunds, transfers, suspensions, or extensions on Gift Cards for change of mind, injury, illness, change of address, or any other reason. All purchases are final.

  • We accept no responsibility if a card is lost, stolen, destroyed, or used without your permission.

  • Gift Cards may be purchased online.
